Trump ve AB, Temmuz 2018&#8217;de bir t\u00fcr ate\u015fkes ilan ederek TTIP&#8217;ye benzer g\u00f6r\u00fcnen m\u00fczakereleri yeniden ba\u015flatt\u0131. 15 Nisan 2019&#8217;da Avrupa Birli\u011fi Komisyonu taraf\u0131ndan, m\u00fczakerelerin &#8220;eskidi\u011fi ve art\u0131k ge\u00e7erli olmad\u0131\u011f\u0131&#8221; ilan edildi.<\/p>\n<p>Ge\u00e7mi\u015f m\u00fczakerelere ili\u015fkin raporlar ve m\u00fczakere edilen TTIP tekliflerinin i\u00e7eri\u011fi kamuoyuna gizlidir ve yaln\u0131zca yetkili ki\u015filer taraf\u0131ndan eri\u015filebilir. Kamuoyuna s\u0131zd\u0131r\u0131lan birka\u00e7 TTIP i\u00e7erik \u00f6nerisi tart\u0131\u015fmalara neden oldu.<\/p>\n<p>Avrupa Birli\u011fi Komisyonu, TTIP&#8217;nin AB ekonomisini 120 milyar \u20ac, ABD ekonomisini 90 milyar \u20ac, d\u00fcnyan\u0131n geri kalan\u0131n\u0131 ise 100 milyar \u20ac b\u00fcy\u00fctece\u011fini s\u00f6yl\u00fcyor. Columbia Hukuk Fak\u00fcltesi&#8217;nde hukuk profes\u00f6r\u00fc olan Anu Bradford ve D\u0131\u015f \u0130li\u015fkiler Konseyi&#8217;nden Thomas J. Bollyky&#8217;ye g\u00f6re, TTIP &#8220;k\u00fcresel ticaretin \u00fc\u00e7te birini liberalle\u015ftirmeyi&#8221; hedefliyor ve milyonlarca yeni istihdam yaratabilir. ABD&#8217;li d\u00fc\u015f\u00fcnce kurulu\u015fu Ekonomi ve Politika Ara\u015ft\u0131rmalar\u0131 Merkezi&#8217;nden Dean Baker taraf\u0131ndan kaleme al\u0131nan bir Guardian makalesi, hane ba\u015f\u0131na ekonomik faydalar\u0131n nispeten k\u00fc\u00e7\u00fck olaca\u011f\u0131n\u0131 savundu. Bir Avrupa Parlamentosu raporuna g\u00f6re, ekonomik modele ve tahminler i\u00e7in kullan\u0131lan varsay\u0131mlara ba\u011fl\u0131 olarak, \u00e7al\u0131\u015fma ko\u015fullar\u0131 \u00fczerindeki etkiler, i\u015f kazan\u0131mlar\u0131ndan i\u015f kay\u0131plar\u0131na kadar uzanmakta.<\/p>\n<p>\u00d6nerilen anla\u015fma, \u00f6zellikle Avrupa&#8217;daki baz\u0131 sendikalar, hay\u0131r kurumlar\u0131, STK&#8217;lar ve \u00e7evreciler taraf\u0131ndan ele\u015ftirilmi\u015f ve anla\u015fmaya kar\u015f\u0131 \u00e7\u0131k\u0131lm\u0131\u015ft\u0131. The Independent, TTIP&#8217;ye y\u00f6nelik yayg\u0131n ele\u015ftirileri &#8220;g\u0131da g\u00fcvenli\u011fi yasas\u0131, \u00e7evre mevzuat\u0131, bankac\u0131l\u0131k d\u00fczenlemeleri ve bireysel uluslar\u0131n egemen g\u00fc\u00e7leri gibi \u015feyler gibi b\u00fcy\u00fck i\u015fletmeler i\u00e7in ticaretin \u00f6n\u00fcndeki mevzuata ili\u015fkin engellerin azalt\u0131lmas\u0131&#8221; veya daha ele\u015ftirel olarak &#8221; ulus\u00f6tesi \u015firketler taraf\u0131ndan Avrupa ve ABD toplumlar\u0131na y\u00f6nelik bir sald\u0131r\u0131&#8221; olarak tan\u0131ml\u0131yor. Guardian, TTIP&#8217;nin &#8220;kapal\u0131 kap\u0131 g\u00f6r\u00fc\u015fmelerinin demokratik olmayan do\u011fas\u0131&#8221;, &#8220;g\u00fc\u00e7l\u00fc lobicilerin etkisi&#8221;, TTIP&#8217;nin &#8220;yerel y\u00f6netimin demokratik otoritesini baltalama&#8221; potansiyeline y\u00f6nelik ele\u015ftirileri not etti ve bunu &#8221; AB\u2019nin \u015fimdiye kadar m\u00fczakere etti\u011fi en tart\u0131\u015fmal\u0131 ticaret anla\u015fmas\u0131&#8221; olarak nitelendirdi. Alman ekonomist Max Otte, TTIP&#8217;nin, Avrupal\u0131 i\u015f\u00e7ileri Amerikal\u0131larla (ve asl\u0131nda Kuzey Amerika Serbest Ticaret Anla\u015fmas\u0131 nedeniyle Meksikal\u0131lar ve Kanadal\u0131larla) do\u011frudan rekabete sokarak, Avrupa sosyal modellerini olumsuz etkileyece\u011fini savundu. Bir AB do\u011frudan demokrasi mekanizmas\u0131 olan Avrupa Vatanda\u015flar\u0131 Giri\u015fimi, AB vatanda\u015flar\u0131n\u0131n do\u011frudan Avrupa Komisyonu&#8217;nu yasal bir eylem \u00f6nermeye davet etmesine olanak tan\u0131rken, bir y\u0131l i\u00e7inde TTIP ve <a href=\"https:\/\/datakapital.com\/blog\/kanada-avrupa-ticaret-anlasmasi\/\">CETA&#8217;ya (Comprehensive Economic and Trade Agreement)<\/a> kar\u015f\u0131 3,2 milyonun \u00fczerinde imza toplad\u0131.<\/p>\n<h2><strong>Ko\u015fullar<\/strong><\/h2>\n<p>AB ve Amerika Birle\u015fik Devletleri aras\u0131ndaki ekonomik engeller, yaln\u0131zca D\u00fcnya Ticaret \u00d6rg\u00fct\u00fc&#8217;ne (WTO) uzun s\u00fcredir devam eden \u00fcyelik nedeniyle de\u011fil, ayn\u0131 zamanda AB-ABD A\u00e7\u0131k Semalar Anla\u015fmas\u0131 gibi son anla\u015fmalar ve Transatlantik Ekonomik Konseyi taraf\u0131ndan yap\u0131lan \u00e7al\u0131\u015fmalar nedeniyle nispeten d\u00fc\u015f\u00fckt\u00fcr. Avrupa Komisyonu, bir trans-Atlantik ticaret anla\u015fmas\u0131n\u0131n ge\u00e7i\u015finin, ilgili bloklar aras\u0131ndaki genel ticareti %50&#8217;ye kadar art\u0131rabilece\u011fini iddia ediyor. Beyaz Saray ve Avrupa Komisyonu taraf\u0131ndan yay\u0131nlanan ortak raporda, bir Ticaret Anla\u015fmas\u0131ndan elde edilecek ekonomik kazan\u0131mlar \u00f6ng\u00f6r\u00fcl\u00fcyordu.<\/p>\n<p>Transatlantik Serbest Ticaret B\u00f6lgesi&#8217;nin bir bi\u00e7imi 1990&#8217;larda ve daha sonra 2006&#8217;da Doha d\u00fcnya ticaret g\u00f6r\u00fc\u015fmelerinin \u00e7\u00f6kmesine tepki olarak Almanya \u015eans\u00f6lyesi Angela Merkel taraf\u0131ndan \u00f6nerildi. Bu, Kuzey Atlantik Antla\u015fmas\u0131 \u00d6rg\u00fct\u00fc&#8217;n\u00fcn varl\u0131\u011f\u0131n\u0131n devam etmesinin yan\u0131 s\u0131ra y\u0131ll\u0131k zirveler, Devlet bakanlar\u0131 aras\u0131nda iki y\u0131lda bir yap\u0131lan toplant\u0131lar ve siyasi \u015fahsiyetler ile \u00fcst d\u00fczey yetkililer aras\u0131nda daha s\u0131k kar\u015f\u0131la\u015fmalar\u0131 gerektirdi.<\/p>\n<p>Avrupal\u0131 karar vericiler ve ABD h\u00fck\u00fcmeti taraf\u0131ndan al\u0131nan m\u00fcteakip giri\u015fimler \u015funlar\u0131 i\u00e7eriyordu: 1995 y\u0131l\u0131nda, i\u015f adamlar\u0131ndan olu\u015fan bir bask\u0131 grubunun olu\u015fturulmas\u0131, Atlantik&#8217;in her iki yakas\u0131ndaki kamu yetkilileri taraf\u0131ndan Transatlantik \u0130\u015f Diyalo\u011fu (TABD); 1998&#8217;de Transatlantik Ekonomik Ortakl\u0131k ad\u0131nda bir dan\u0131\u015fma komitesinin olu\u015fturulmas\u0131; 2007&#8217;de Atlantik&#8217;in her iki yakas\u0131nda faaliyet g\u00f6steren firmalar\u0131n temsilcilerinin Avrupa Komisyonu&#8217;na ve ABD h\u00fck\u00fcmetine tavsiyelerde bulunmak \u00fczere bir araya geldi\u011fi Transatlantik Ekonomik Konseyi&#8217;nin olu\u015fturulmas\u0131 ve son olarak 2011&#8217;de olu\u015fturulan bir \u00fcst d\u00fczey uzman grubu taraf\u0131ndan 11 \u015eubat 2013&#8217;te sunulan sonu\u00e7lar, geni\u015f kapsaml\u0131 bir serbest ticaret anla\u015fmas\u0131 i\u00e7in m\u00fczakerelerin ba\u015flat\u0131lmas\u0131n\u0131 tavsiye ediyordu. 12 \u015eubat 2013&#8217;te Ba\u015fkan Barack Obama, y\u0131ll\u0131k Birli\u011fin Durumu konu\u015fmas\u0131nda b\u00f6yle bir anla\u015fma i\u00e7in \u00e7a\u011fr\u0131da bulundu. Amerika Birle\u015fik Devletleri ve Avrupa Birli\u011fi, d\u00fcnyadaki di\u011fer bir\u00e7ok \u00fclkenin en b\u00fcy\u00fck ticaret ortaklar\u0131d\u0131r ve d\u00fcnya ticaret ak\u0131\u015flar\u0131n\u0131n \u00fc\u00e7te birini olu\u015fturmaktad\u0131r. Halihaz\u0131rda d\u00fc\u015f\u00fck tarife engelleri (%3&#8217;\u00fcn alt\u0131nda) g\u00f6z \u00f6n\u00fcne al\u0131nd\u0131\u011f\u0131nda, anla\u015fmay\u0131 ba\u015far\u0131l\u0131 k\u0131lmak i\u00e7in ama\u00e7 tarife d\u0131\u015f\u0131 engelleri kald\u0131rmakt\u0131r.<\/p>\n<h3><strong>\u00d6nerilen \u0130\u00e7erikler<\/strong><\/h3>\n<p><a href=\"https:\/\/www.ab.gov.tr\/avrupa-komisyonu_45629.html\" target=\"_blank\" rel=\"noopener\">Avrupa Komisyonu<\/a> taraf\u0131ndan Temmuz 2014&#8217;te yay\u0131nlanan belgeler, tart\u0131\u015f\u0131lan konular\u0131 \u00fc\u00e7 geni\u015f alanda grupland\u0131r\u0131yor: Pazara eri\u015fim; \u00d6zel d\u00fczenleme; ve daha geni\u015f kurallar, ilkeler ve i\u015f birli\u011fi bi\u00e7imleri.<\/p>\n<p>Haziran 2013 itibariyle AB m\u00fczakere direktifi, Avrupa Birli\u011fi Konseyi&#8217;nin (D\u0131\u015fi\u015fleri) m\u00fczakerecilerine her b\u00f6l\u00fcm i\u00e7in ba\u015farmaya \u00e7al\u0131\u015fmalar\u0131 gerekenler konusunda daha kapsaml\u0131 bir \u015fekilde yol g\u00f6sterdi. Buna kar\u015f\u0131l\u0131k gelen bir ABD metni yok, ancak Amerikan taraf\u0131 hedeflerini ve \u00f6ng\u00f6rd\u00fc\u011f\u00fc potansiyel faydalar\u0131 ortaya koyan bir kamu bildirisi yay\u0131nlad\u0131.<\/p>\n<p>\u0130lk somut Amerikan tarife indirimi \u00f6nerisinin ve \u015eubat 2016&#8217;da Correctiv&#8217;e s\u0131zd\u0131r\u0131lan bir AB kar\u015f\u0131 teklifinin gizli i\u00e7erikleri, t\u00fcm tarifelerin %87,5 ila %97&#8217;sinin s\u0131f\u0131ra indirilece\u011fini g\u00f6steriyor.<\/p>\n<h3><strong><em>Pazar Eri\u015fimi<\/em><\/strong><\/h3>\n<p>TTIP, &#8220;mallar \u00fczerindeki g\u00fcmr\u00fck vergilerini ve hizmetler \u00fczerindeki k\u0131s\u0131tlamalar\u0131 kald\u0131rmay\u0131, kamu piyasalar\u0131na daha iyi eri\u015fim sa\u011flamay\u0131 ve yat\u0131r\u0131m yapmay\u0131 kolayla\u015ft\u0131rmay\u0131&#8221; ama\u00e7layan mal ve hizmetler i\u00e7in piyasaya eri\u015fim b\u00f6l\u00fcmleri i\u00e7ermektedir. Mallar k\u0131sm\u0131, mallar, tar\u0131m ve i\u015flenmi\u015f tar\u0131m \u00fcr\u00fcnleri i\u00e7in pazara giri\u015f kurallar\u0131 ve men\u015fe kurallar\u0131n\u0131 i\u00e7erir.<\/p>\n<h3><strong><em>Hizmetler ve S\u0131zd\u0131r\u0131lm\u0131\u015f Metin<\/em><\/strong><\/h3>\n<p>&#8220;Hizmet Ticareti, Yat\u0131r\u0131m ve E-ticaret&#8221; i\u00e7in 7 Temmuz 2013 tarihli taslak metin Alman Die Zeit gazetesi taraf\u0131ndan Mart 2014&#8217;te s\u0131zd\u0131r\u0131ld\u0131. S\u0131zan metin yedi b\u00f6l\u00fcmden olu\u015fuyor. B\u00f6l\u00fcm 1&#8217;de, Madde 1, &#8220;ticaret ve yat\u0131r\u0131m\u0131n geli\u015fimi i\u00e7in daha iyi bir iklim&#8221;, ve \u00f6zellikle &#8220;e-ticarette yat\u0131r\u0131m ve i\u015f birli\u011finin serbestle\u015ftirilmesi&#8221; genel hedefini belirtmektedir.<\/p>\n<p>B\u00f6l\u00fcm II, Madde 3 ila Madde 18, yat\u0131r\u0131m i\u00e7in genel ilkeleri i\u00e7erir. 14. Madde, h\u00fck\u00fcmetlerin, kamu amac\u0131na y\u00f6nelik olmad\u0131\u011f\u0131 s\u00fcrece, ayr\u0131m g\u00f6zetmeksizin ve tazminat kar\u015f\u0131l\u0131\u011f\u0131nda &#8220;do\u011frudan veya dolayl\u0131 olarak kamula\u015ft\u0131rmas\u0131n\u0131, istimlak etmesini&#8221; yasaklayan \u00f6nerilen kurallar\u0131 i\u00e7ermektedir. Madde 14(2), gerekli tazminat\u0131 &#8220;yat\u0131r\u0131m\u0131n kamula\u015ft\u0131rman\u0131n hemen \u00f6ncesindeki veya yakla\u015fmakta olan kamula\u015ft\u0131rman\u0131n kamuya a\u00e7\u0131k hale gelmesinden hemen \u00f6nceki adil piyasa de\u011feri art\u0131 piyasa baz\u0131nda belirlenen ticari bir oranda faiz&#8221; olarak tan\u0131mlamaktad\u0131r.<\/p>\n<p>B\u00f6l\u00fcm III, Madde 19 ila 23, hizmetlerin s\u0131n\u0131r \u00f6tesi arz\u0131na ili\u015fkin kurallar\u0131 i\u00e7erir.<\/p>\n<p>B\u00f6l\u00fcm IV, Madde 24 ila 28, anla\u015fmaya taraf olan t\u00fcm \u00fclkeler aras\u0131nda i\u015fletme y\u00f6neticilerinin ve bir \u015firketin di\u011fer \u00e7al\u0131\u015fanlar\u0131n\u0131n ge\u00e7ici \u00e7al\u0131\u015fma ama\u00e7lar\u0131yla serbest dola\u015f\u0131m\u0131na izin verecektir. B\u00f6l\u00fcm IV, 35 ila 39. maddeler, posta hizmetlerinin serbestle\u015ftirilmesini kapsar.
