Anla\u015fma yoluyla kurumsalla\u015ft\u0131r\u0131lan i\u015f birli\u011fi mekanizmalar\u0131 g\u00f6z \u00f6n\u00fcne al\u0131nd\u0131\u011f\u0131nda, bu ihtimal g\u00f6z ard\u0131 edilemez. Kanada, i\u015f ve turizm amac\u0131yla Kanada&#8217;y\u0131 ziyaret eden Bulgar ve Romanya vatanda\u015flar\u0131n\u0131n vize \u015fartlar\u0131n\u0131 en ge\u00e7 2017 y\u0131l\u0131 sonuna kadar iptal edece\u011fine dair yaz\u0131l\u0131 taahh\u00fctte bulunduktan sonra, 1 Aral\u0131k 2017&#8217;de Bulgaristan ve Romanya vatanda\u015flar\u0131 i\u00e7in vize \u015fartlar\u0131n\u0131 kald\u0131rd\u0131.<\/p>\n<h3><strong><em>Yat\u0131r\u0131m Korumas\u0131 ve Yat\u0131r\u0131mc\u0131-Devlet Mahkemeleri<\/em><\/strong><\/h3>\n<p>CETA&#8217;n\u0131n 4. B\u00f6l\u00fcm\u00fc (sayfa 158-161) yabanc\u0131 yat\u0131r\u0131mc\u0131lara Yat\u0131r\u0131m Korumas\u0131 sa\u011flar ve &#8220;adil ve hakkaniyetli muamele ve tam koruma ve g\u00fcvenlik&#8221; garanti eder.<\/p>\n<p>CETA, yabanc\u0131 \u015firketlerin, bir devletin Ayr\u0131mc\u0131 Olmayan Muamele y\u00fck\u00fcml\u00fcl\u00fcklerini (CETA, b\u00f6l\u00fcm 3, s. 156 f) ihlal etmesi veya garanti edilen yat\u0131r\u0131m korumas\u0131n\u0131n ihlali nedeniyle zarara u\u011frad\u0131\u011f\u0131n\u0131 iddia etmeleri halinde, devletleri tahkim mahkemelerinde dava etmelerine izin verir.<\/p>\n<p>Bu lisans yaln\u0131zca bir y\u00f6nde mevcuttur; devletler, bu yat\u0131r\u0131mc\u0131-devlet tahkimlerinde \u015firketlere dava a\u00e7amaz. (Madde X.39: H\u00fck\u00fcmlerin tenfizi, s. 177)<\/p>\n<p>26 Mart 2014&#8217;te Alman Ekonomi Bakan\u0131 Sigmar Gabriel, AB Ticaret Komiseri Karel De Gucht&#8217;a, yat\u0131r\u0131m korumas\u0131n\u0131n merkezi hassas nokta oldu\u011funu belirten bir a\u00e7\u0131k mektup yazd\u0131 ve bu, transatlantik bir serbest ticaret anla\u015fmas\u0131n\u0131n Alman onay\u0131yla kar\u015f\u0131lan\u0131p kar\u015f\u0131lanmayaca\u011f\u0131na karar verebilirdi. Ayr\u0131ca, iyi geli\u015fmi\u015f hukuk sistemlerine sahip \u00fclkeler aras\u0131nda yat\u0131r\u0131m tahkimine gerek olmad\u0131\u011f\u0131n\u0131 belirtti.<\/p>\n<p>CETA &#8220;Yat\u0131r\u0131mc\u0131-Devlet Uyu\u015fmazl\u0131k \u00c7\u00f6z\u00fcm\u00fc&#8221; (ISDS) h\u00fck\u00fcmleri, <a href=\"https:\/\/datakapital.com\/blog\/transatlantik-ticaret-ve-yatirim-ortakligi-ttip\/\">TTIP (Transatlantik Ticaret ve Yat\u0131r\u0131m Anla\u015fmas\u0131)<\/a> i\u00e7indeki benzer d\u00fczenlemeler i\u00e7in emsal olu\u015fturabilir. Ayr\u0131ca, ele\u015ftirmenler CETA&#8217;n\u0131n ABD \u015firketlerinin Kanada yan kurulu\u015flar\u0131 arac\u0131l\u0131\u011f\u0131yla AB \u00fclkelerine dava a\u00e7mas\u0131na izin verece\u011fini iddia ediyor.<\/p>\n<p>2016 y\u0131l\u0131nda AB Komisyonu, Kanada h\u00fck\u00fcmetiyle CETA&#8217;daki ge\u00e7ici tahkim mahkemelerini kal\u0131c\u0131 bir uyu\u015fmazl\u0131k \u00e7\u00f6z\u00fcm mahkemesi ile de\u011fi\u015ftirmeyi kabul etti\u011fini duyurdu. Mahkeme, Kanada ve AB taraf\u0131ndan belirlenen 15 \u00fcyeden olu\u015facak ve bireysel davalara \u00fc\u00e7 ki\u015filik paneller halinde bakacak. \u00d6d\u00fcllerin &#8220;hukuki do\u011frulu\u011funu&#8221; sa\u011flamak i\u00e7in bir temyiz mekanizmas\u0131 kurulacakt\u0131r. Mahkemenin \u00fcyeleri, di\u011fer yat\u0131r\u0131m davalar\u0131nda uzman veya taraf dan\u0131\u015fman\u0131 olarak yer alamaz.<\/p>\n<h3><strong>\u0130mza ve Onay<\/strong><\/h3>\n<p>Avrupa Komisyonu, anla\u015fman\u0131n yaln\u0131zca AB&#8217;nin yetkisinde oldu\u011funu d\u00fc\u015f\u00fcnd\u00fc\u011f\u00fcnden, ba\u015flang\u0131\u00e7ta AB \u00fcye devletlerinin anla\u015fmay\u0131 onaylamas\u0131 gerekip gerekmedi\u011fi belirsizdi. Ancak, Temmuz 2016&#8217;da CETA&#8217;n\u0131n &#8220;karma anla\u015fma&#8221; olarak nitelendirilmesine ve dolay\u0131s\u0131yla ulusal prosed\u00fcrlerle de onaylanmas\u0131na karar verildi.<\/p>\n<p>27 Ekim 2016&#8217;da CETA&#8217;n\u0131n planlanan imzas\u0131ndan k\u0131sa bir s\u00fcre \u00f6nce, Bel\u00e7ika, t\u00fcm b\u00f6lgesel h\u00fck\u00fcmetler taraf\u0131ndan onay istendi\u011fi i\u00e7in anla\u015fmay\u0131 imzalayamad\u0131\u011f\u0131n\u0131 a\u00e7\u0131klad\u0131. S\u0131ras\u0131yla merkez sa\u011f Michel ve Burjuva h\u00fck\u00fcmetleri taraf\u0131ndan y\u00f6netilen federal h\u00fck\u00fcmet ve Flanders lehteyken, federal d\u00fczeyde muhalefette olan merkez sol partilerin ba\u015f\u0131n\u0131 \u00e7ekti\u011fi Frans\u0131z Toplulu\u011fu, Wallonia ve Br\u00fcksel, anla\u015fmay\u0131 reddetti. 27 Nisan 2016&#8217;da Valon Parlamentosu CETA&#8217;ya kar\u015f\u0131 bir karar\u0131 ge\u00e7irmi\u015fti. 13 Ekim 2016&#8217;da David Lametti, bir Valon Parlamentosu komitesi \u00f6n\u00fcnde CETA&#8217;y\u0131 savundu.
